Seller Agreement

This Seller Agreement contains the sections of the HeartYourYard Terms of Use that apply when you sell in Bazaar, and forms part of those Terms. The rest of the Terms of Use applies to your selling as well. By opening a shop you agree to it.

5. Bazaar Marketplace Terms

5.2 Seller Terms

  • Sellers must accurately describe items listed for sale, including species, condition, and any care requirements.
  • Sellers are solely responsible for complying with all applicable laws regarding the sale and shipment of plants — see Section 5.4 and the separate Prohibited Species & Shipping Policy.
  • Sellers agree to fulfill orders promptly and to the standard described in their listing.
  • HeartYourYard charges a commission of [rate to be stated] of the item price on each completed sale.

5.4 Shipping and Compliance

Sellers are solely responsible for complying with all applicable laws regarding the sale and shipment of plants, including but not limited to: state/provincial agricultural regulations, restrictions on shipping specific species across state or regional lines, and any applicable licensing or phytosanitary certificate requirements. HeartYourYard currently supports domestic shipping only within the United States; sellers may not use the Service to ship plants internationally. HeartYourYard does not verify seller compliance with these regulations and disclaims all liability for a seller’s failure to comply.

5.5 Prohibited Species

Sellers may not list or sell any plant species that is protected, restricted, invasive, or otherwise illegal to sell or transport under applicable law, including species listed under CITES (Convention on International Trade in Endangered Species) or any federal, state, or local noxious/invasive species list. See our Prohibited Species & Shipping Policy for details. Violations may result in listing removal and account termination.

5.6 Seller Certification

At the time of creating a listing, sellers must affirmatively certify:

  • I certify that this plant is legal to sell and ship within the United States, is not a restricted, invasive, or noxious species under applicable law, and is not listed under CITES. I understand I am solely responsible for compliance with shipping regulations in my state/region.

6. Payments and Payouts

  • Payments for Bazaar purchases are processed through PayPal and paid directly into the seller’s PayPal account.
  • Seller payouts are issued via PayPal, subject to identity verification (KYC).
  • HeartYourYard’s fees are described in Section 5.2.
  • Tax reporting: [who issues 1099-K or equivalent forms — HeartYourYard or the payment platform — and under what threshold, to be decided and described here].
